1. Acceptance of Terms

By accessing or using MyN95Certificate.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and MyN95Certificate.com ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

MyN95Certificate.com provides an online platform for obtaining OSHA 1910.134 respirator medical clearance certification. Our services include:

• Administration of the OSHA Appendix C medical questionnaire
• Evaluation of questionnaire responses by licensed healthcare providers (PLHCPs)
• Issuance of medical clearance certificates for respirator use
• Generation of digital certificates and wallet cards with QR code verification
• Certificate sharing and supervisor notification features
• Expiration tracking and renewal reminders

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Be legally authorized to work in a position requiring respirator use
• Provide accurate and complete information during registration and questionnaire completion
• Have a valid email address for account communications

4. User Responsibilities

As a user of our Service, you agree to:

4.1 Accurate Information

• Provide truthful, accurate, and complete information on all forms, including the medical questionnaire
• Not misrepresent your identity, health status, or employment information
• Update your account information if it changes

4.2 Account Security

• Maintain the confidentiality of your account credentials
• Not share your account with others
• Notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

4.3 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent, disable, or interfere with security features
• Use automated systems (bots, scrapers) to access the Service
• Submit false information to obtain certificates fraudulently
• Share, sell, or transfer certificates to others
• Alter, forge, or falsify certificates or verification codes

5. Payment Terms

5.1 Pricing

• New Certification: $25.00 USD
• Renewal Certification: $20.00 USD (for existing users with a previous certificate)

All prices are in US Dollars and include the medical questionnaire evaluation, certificate, and wallet card. Prices are subject to change with notice.

5.2 Payment Processing

Payments are processed securely through Stripe. We accept major credit cards and debit cards. By providing payment information, you represent that you are authorized to use the payment method.

5.3 Refund Policy

Refunds are available only if requested before you begin the medical questionnaire.

Once you have started the questionnaire, your payment is non-refundable because:

• The evaluation process has begun and healthcare provider resources have been allocated
• Your questionnaire responses become part of your medical record

To request a refund before starting the questionnaire, contact support@myn95certificate.com.

5.4 Chargebacks

If you dispute a charge with your credit card company after completing the questionnaire, we reserve the right to suspend your account and revoke any issued certificates pending resolution of the dispute.

6. Certificate Validity and Limitations

6.1 Validity Period

Medical clearance certificates are valid for one (1) year from the date of issuance, unless a shorter period is specified by the evaluating healthcare provider or required by your employer.

6.2 Scope of Certification

Our certification covers:

• Medical clearance for negative-pressure air-purifying respirators (including N95s, half-mask, and full-face respirators)
• Completion of OSHA 1910.134 Appendix C medical questionnaire
• Evaluation by a licensed PLHCP (Physician or other Licensed Health Care Professional)

6.3 What This Certification Does NOT Include

Important: Our service provides medical clearance based on questionnaire responses only. This certification:

• Does NOT include respirator fit testing - Fit testing is a separate OSHA requirement that must be performed by your employer
• Does NOT include a physical examination - If your questionnaire responses indicate potential health concerns, the PLHCP may recommend a physical examination, which would need to be performed separately by your personal physician
• Does NOT cover SCBA or supplied-air respirators - Different requirements apply for these respirator types
• Does NOT replace employer-specific requirements - Your employer may have additional requirements beyond OSHA minimums

6.4 Re-Evaluation

You should seek re-evaluation before your certificate expires or sooner if:

• You experience significant changes in your health status
• You develop respiratory, cardiovascular, or other conditions that may affect respirator use
• Your employer observes signs that you may need re-evaluation
• Your healthcare provider recommends it

7. Disclaimer

IMPORTANT: THIS SERVICE IS NOT A SUBSTITUTE FOR A COMPREHENSIVE MEDICAL EXAMINATION.

Our medical clearance is based solely on the OSHA Appendix C medical questionnaire. While this questionnaire is approved by OSHA for screening purposes, it is not a comprehensive medical evaluation.

If you have concerns about your ability to safely wear a respirator, you should consult with your personal physician regardless of whether you receive clearance through our service.

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for the Service
• We are not liable for any harm resulting from your failure to provide accurate information
• We are not liable for your employer's acceptance or rejection of our certificates
• We are not liable for any workplace injuries or health issues related to respirator use

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of MyN95Certificate.com or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may download and print certificates issued to you for personal use. You may not reproduce, distribute, or create derivative works from our website content without our written permission.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Providing false or misleading information
• Fraudulent activity
• Abuse of the Service or other users

You may close your account at any time by contacting support@myn95certificate.com. Account closure does not entitle you to a refund for previously purchased services.

11. Indemnification

You agree to indemnify, defend, and hold harmless MyN95Certificate.com, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any false information you provide

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyN95Certificate.com regarding your use of the Service and supersede any prior agreements.
